The Supreme Court is the executor of judgments of the European Court of Human Rights regarding measures of individual nature and actively cooperates, particularly, with the Ministry of Justice of Ukraine in terms of taking measures of general nature. This fact was underlined by the President of the Supreme Court Valentyna Danishevska while presenting her speech on the VIII International Forum on the Case-Law of the European Court of Human Rights.
“Presently, we are at the new stage of comprehension of the Convention for the Protection of Human Rights and Fundamental Freedoms and the practice of its application. Profound studying of judgments of the European Court of Human Rights lets us avoid formalistic approaches to the interpretation of laws and strengthen the motivation of our own judgments; such situation promotes increasing society’s trust in court”, – Valentyna Danishevska remarked.
According to the SC President, the judicial system is searching for ways of solution of several burning issues, particularly, those concerning the duration of cases consideration and increasing the level of execution of national courts’ judgments (in execution of the ECHR judgment in the case Burmych and Others v. Ukraine). The ECHR judgment regarding the application of the Law of Ukraine “On the Purification of Power” will also represent a serious challenge for Ukraine.
Valentyna Danishevska emphasized that the priority spheres of judges’ activity in Ukraine were represented with the application of appropriate and relevant case-law of the European Court of Human Rights, as well as taking measures, which would promote the prevention and elimination of violations while considering cases at national level, particularly, by means of systematic execution of the ECHR judgments.
