Requirement as for Personal Consideration of Addresses of Disabled Veterans Shall Extend to the President of Ukraine – SC GC

The Grand Chamber of the Supreme Court has satisfied claim on the recognition of the activity of the President of Ukraine – the Head of the National Security and Defense Council of Ukraine as unlawful. The plaintiff – disabled veteran – applied to the President of Ukraine with address, asking to inform him personally in written form about results of the examination of facts noted in the claim previously submitted by him. However, this address was transferred by the staff of the Presidential Administration to another public authority for its consideration.

The SC Grand Chamber concluded that addresses of individuals noted in part 2 of Article 14, part 2 of Article 15, part 2 of Article 16 of the Law of Ukraine “On Citizens’ Addresses” should be considered personally by chairpersons of public bodies. The noted procedure shall concern the President of Ukraine, as well.

Such position is presented in the Resolution of the SC Grand Chamber of 12 November 2019 in the case No. 9901/21/19 (proceedings 11-810çà³19).
