Judges of the Commercial Cassation Court within the Supreme Court Participated in the Thirteenth Multinational Judicial Colloquium on Insolvency

Judges of the Supreme Court Serhii Zhukov, Liliia Katerynchuk and Viacheslav Pieskov participated in the Thirteenth Multinational Judicial Colloquium on Insolvency on 1-2 April 2019 in Singapore under the auspices of the International Association of Restructuring, Insolvency & Bankruptcy Professionals (INSOL).

More than 120 representatives from 44 countries considered issues of interaction among legal systems of general and continental (statutory) law while administering justice in insolvency cases with foreign element, execution of international assignments within insolvency cases and a range of related issues.

The colloquium participants emphasized that these issues had especially great significance in the light of involvement of foreign investments, guaranteeing rights of foreign investors and ensuring the principles of openness and effectiveness while conducting proceedings in insolvency cases.

In their reports and discussions the judges raised issues of the unification of approaches while applying the UNCITRAL Model Law on Cross-Border Insolvency, the interaction of judges from different countries as for the noted issues, as well as considered the advantages of the pre-trial settlement of disputes via the application of mediation procedures, etc.
