Due process ensures justice and the protection of human rights – SC AdmCC President

President of the Administrative Cassation Court within the Supreme Court Mykhailo Smokovych took part in the International Scientific and Practical Conference “Constitutional Foundations of Due Process: Challenges of European Integration”, which was held on the occasion of the 150th anniversary of the founding of Yuriy Fedkovych Chernivtsi National University.

In this context, Mykhailo Smokovych spoke about the Law of Ukraine “On Administrative Procedure”, which came into force on December 15, 2023 after many years of work on the text of the bill and discussions. This legislative act was developed to ensure a unified and transparent procedure for the consideration of administrative cases throughout Ukraine, to improve the interaction between the government and the individual, and to put an end to the situation when the rules for considering an issue depended on the institution that dealt with it.

Mykhailo Smokovych noted that this Law is designed to harmonize national administrative legislation with European standards and ensure a unified procedure for administrative procedures based on the rule of law and transparency. This helps to improve administrative practice and provides a reliable mechanism for protecting the rights of individuals.

Equally important are the issues of educational and awareness-raising activities, cooperation with scholars, practitioners and other institutions to ensure a common understanding of the rules and improve administrative activities. The President of the SC AdmCC also drew attention to the statistical indicators that show positive dynamics in the practice of applying the new legislation and ensuring effective protection of individuals from violations by public authorities.

The event is organized by Yuriy Fedkovych Chernivtsi National University in cooperation with partners and with the support of the OSCE.
