Ensuring unity and consistency of constitutional interpretation: Supreme Court joins inter-institutional dialogue on upholding constitutional values

The Supreme Court has many points of contact with the Constitutional Court of Ukraine in its activities. This includes the Supreme Court's Plenum appealing to the CCU with submissions on the constitutionality of certain legislative provisions, and judges of the Supreme Court — particularly the Grand Chamber — constantly analysing the CCU's decisions when adopting the Supreme Court's legal positions. Cooperation between the two judicial institutions has always been fruitful. Nevertheless, it is important to hold a more detailed joint discussion on topics related to constitutional values, especially in the context of their interpretation, in order to guarantee the protection of human rights and freedoms based on globally accepted approaches.

This was stated by President of the Supreme Court Stanislav Kravchenko in his welcoming speech to the participants of the dialogue ‘Constitutional values as the basis for a court decision: harmonising approaches and interpretations’. The event was organised by The Aspen Institute Kyiv in partnership with the OSCE Support Programme for Ukraine.

The dialogue took place within the framework of the Justice, Law and Society Programme, which aims to create a platform for communication between professionals in the field of law, public administration and human rights, and brought together judges of the Constitutional Court of Ukraine and the Supreme Court to establish institutional interaction.

The participants were also welcomed by Denis Poltavets, Programme Development Director at The Aspen Institute Kyiv, and Oksana Hryshchuk, Judge of the Constitutional Court of Ukraine. The discussion was moderated by Denis Poltavets and Olena Boryslavska, Head of the Department of Constitutional Law at the Ivan Franko National University of Lviv.

The event was coordinated by Olena Fomina, Policy Programme Director at The Aspen Institute Kyiv.

During the dialogue, the participants discussed the following aspects:

  • democratic governance challenges;
  • meeting the public's demand for justice;
  • means of ensuring the stability of the constitutional order and protection of fundamental human rights and freedoms;
  • mechanisms of interaction between institutions in the implementation of constitutional norms.
