Supreme Court representatives visit the Netherlands as part of a visit dedicated to fair trial standards in war crimes cases

Enhancing the standards of fair trial in war crimes cases in Ukraine was the subject of a working visit to The Hague (the Netherlands) by Supreme Court judges in the Criminal Cassation Court Oleksandra Yanovska and Serhii Fomin and Deputy Head of the Department for Analytical and Legal Work of the Supreme Court Hennadii Zelenov.

During the study visit, the participants had the opportunity to contribute to the identification of concrete recommendations for strengthening the legal framework and the rule of law in Ukraine, share experiences in ensuring the right to a fair trial and learn about best judicial practices. The programme of the visit also included a critical analysis of the systemic challenges caused by the Russian aggression against Ukraine and the search for effective solutions based on international standards.

Representatives of the Supreme Court took part in practical sessions at the Asser Institute, a mock trial, a presentation of the ‘Fair Trial Rights Handbook for Lawyers in Ukraine’ prepared by the Asser Institute, and visited the International Criminal Court and the Kosovo Specialist Chambers.

In addition, during the visit, Supreme Court Judge at the Criminal Cassation Court Oleksandra Yanovska delivered a presentation on ‘Issues of admissibility of evidence in war crimes proceedings in Ukraine’, and Deputy Head of the Department for Analytical and Legal Work of the Supreme Court Hennadii Zelenov spoke about the most pressing legal challenges faced by legal practitioners in Ukraine involved in the investigation and trial of war crimes criminal proceedings.

The visit was part of the project ‘Restoring Dignity and People-Centred Justice in Ukraine’ and was organised by the International Development Law Organisation (IDLO) in partnership with the Asser Institute, the Centre for International Legal Cooperation (CILC), the Netherlands Helsinki Committee (NHC) with the support of the Ministry of Foreign Affairs of the Netherlands.
