Compliance of Ukrainian legislation with EU law: Supreme Court judge takes part in bilateral meeting between Ukraine and the European Commission

Olena Kibenko, Supreme Court Judge at the Commercial Cassation Court, was a member of the Ukrainian delegation at the bilateral meeting between Ukraine and the European Commission on the compliance of Ukrainian legislation with EU law under negotiating chapter 6 ‘Corporate Law’ within cluster 2 ‘Internal Market’, which took place in Brussels (Belgium).

The meeting included the presentation of the results of the screening of Ukrainian legislation for compliance with the main directives and regulations in the field of corporate law, in particular on the following issues: shareholders' rights and corporate governance; formation of company capital and disclosure of information; reorganisation and acquisition of companies; use of digital tools in corporate law; anti-corruption measures in the field of corporate law, etc.

Olena Kibenko answered a number of questions from the European Commission's experts, including the legal consequences of invalidating a company's reorganisation or establishment, the procedure for disclosing information about companies in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Associations and the possibility for third parties to rely on such disclosure in the event of disputes.

The judge also participated in a simulation session with government agencies and international experts to prepare for the meeting.

Such bilateral meetings between the representatives of Ukraine and the European Commission are an important stage in the negotiation process on Ukraine's accession to the EU and confirm our country's course towards integration into the European market.
