Supreme Court upholds the sentence of a foreigner who provided a military prosecutor with USD 75,000 in illegal gratification

The Criminal Cassation Court of the Supreme Court upheld the decisions of the courts of previous instances, according to which a Moldovan citizen was found guilty of offering and giving an undue advantage to an official (Part 3 of Article 369 of the Criminal Code of Ukraine) and sentenced to 5 years in prison. A special confiscation was also applied and USD 75,000 was seized into state ownership.

According to the circumstances of the criminal proceedings, in May 2021, the co-owner of the company that owned the seized vessel and cargo, in order to lift the arrest and avoid possible confiscation of this property, made a proposal to provide an undue advantage to the prosecutor of the military prosecutor's office. Subsequently, during a meeting held under the control of law enforcement agencies, the convict handed over USD 75,000 of unlawful benefit to the prosecutor for taking the necessary procedural actions to lift the arrest.
