Ukraine becomes 35th country whose court decisions will appear in the international intellectual property database

This option was made available following the signing of the Memorandum of Understanding between the Supreme Court and the World Intellectual Property Organisation (WIPO) on the WIPO Lex-Judgments database. The document was signed by Stanislav Kravchenko, President of the Supreme Court, and Daren Tang, Director General of WIPO.

The purpose of the Memorandum is to establish cooperation and promote the dissemination of leading IP judgments through the WIPO Database.

WIPO's Lex-Judgments database, launched by WIPO in September 2020, provides access to the most important judgments from around the world relating to intellectual property law, which have been identified by the courts themselves or by other national authorities of each member state as being of particular importance because of their weight or significance as precedents.

WIPO provides the Supreme Court with access to a web interface for entering judgments and relevant information into the WIPO Lex-Judgments database.

For its part, the Supreme Court selects the judgments to be included in the database at its own discretion, mainly on the basis of the following non-cumulative criteria:

  • final judgments on the merits of the case delivered by the court;
  • judgments that set precedents or provide convincing interpretations for future judgments;
  • judgments cited in other judgments or otherwise highly regarded by academics or the legal community;
  • judgments that have a significant impact on the subject matter of the dispute (e.g. issues arising from recent technological developments or relating to the impact on the economic sector).

WIPO Lex-Judgments complements the information in the WIPO Lex database, a repository of WIPO's global collection of intellectual property laws and treaties. The database contains detailed bibliographical information on all relevant decisions (searchable), including their subject matter, the name of the body that took the decision, the type of consideration, the relevant provisions of the regulations, keywords and summaries, as well as the full texts of the decisions in the original language.

Joining this database opens up new opportunities and prospects for Ukraine's further development, particularly in the field of intellectual property. Despite Russia's full-scale invasion and aggression, international partners have once again demonstrated their support for Ukraine's integration into the EU intellectual property system.
