E-justice: mandatory registration and use of electronic offices in UJITS

Today, on 20 July 2023, the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Concerning Mandatory Registration and Use of Electronic Offices in the Unified Judicial Information and Telecommunication System or its separate subsystem (module) Providing for Exchange of Documents" (No. 3200-IX of 29 June 2023) was published.

Within 90 days from the date of its publication, in accordance with the requirements of the Commercial Procedural Code of Ukraine, the Code of Administrative Proceedings of Ukraine, and the Code of Civil Procedure of Ukraine, the following persons and entities must have electronic offices in the UJITS or its separate subsystem (modules):

  • lawyers;
  • notaries;
  • public and private enforcement officers;
  • bankruptcy trustees;
  • forensic experts;
  • public authorities and other state bodies;
  • local self-government bodies;
  • other legal entities.

Others register their electronic offices on a voluntary basis.

At the same time, there is an exception for administrative and civil proceedings: the rules on the obligation to register electronic offices by legal entities (private form of ownership) will enter into force seven months after the publication of Law No. 3200-IX.

By registering an electronic office, a person who has passed the electronic identification will have access to the information and services of the UJITS or its individual subsystems (modules). In particular, registered users may exchange (send and receive) documents (including procedural documents, written and electronic evidence, etc.) between the court and the parties, as well as between the parties themselves. The electronic identification of a person is carried out by the use of a qualified electronic key or other means of electronic identification that allows for unique identification.

Official e-mail addresses registered before the entry into force of this Law shall be considered electronic offices and shall be used by the court and the parties to the case.

Cases brought before the courts of first, appeal and cassation instances before the entry into force of Law No. 3200-IX shall be considered in accordance with the rules in force after the entry into force of that Law.
