During the London Global Conference Tetiana Antsupova Spoke About the Legal Limits of Justice and Responsibility of the Aggressor

The aggressive war waged by Russia against Ukraine is a clear deliberate and conscious violation of the principles and norms of international humanitarian law and human rights. It is also obvious that this is a challenge for the international legal order in understanding responsibility for serious crimes and prevention of such crimes.

This was emphasized by Judge of the Grand Chamber of the Supreme Court Tetiana Antsupova during her speech at the "2022 London Global Conference". The international event was organized by the New York State Bar Association in London on 30 November - 2 December 2022.

The opening speech of the first day of the event was delivered by the Lord Chief Justice of England and Wales, The Right Honourable Lord Ian Duncan Burnett of Maldon. He focused on the issues of the event and supported the people of Ukraine in their fight against the invader. Other participants, aware of the destructive actions of Russian aggression for the whole Europe, expressed their solidarity with Ukraine.

A separate panel was devoted to the issues of law during war, where speakers explored the role of law in conflict and post-conflict situations. The participants discussed the role of the UN, the International Criminal Court and other international bodies in the context of human rights, war crimes and other criminal law issues.

 

At the invitation of the Ukrainian Bar Association Tetiana Antsupova made a presentation on "Ukraine and legal limits of justice and responsibility". According to her, the judiciary of Ukraine now faces new professional challenges. The main burden of handling criminal proceedings on war crimes will fall on national courts. That is why today it is extremely important and necessary to ensure a unified methodology of handling war crimes cases. This will contribute to the implementation of fair, impartial, objective, timely and transparent justice.

The speaker emphasized that in order to ensure accountability of Russian political leaders for the crime of aggression in Ukraine, it was necessary to support the establishment of a special international tribunal.

One of the biggest challenges for Ukraine's judiciary is the increasing number of cases involving claims for compensation from victims whose property was destroyed or damaged as a result of Russia's war against Ukraine. The SC Grand Chamber judge told about the key decisions made by the Supreme Court in this context.

"In the face of Russia's large-scale aggressive war against Ukraine and the entire Western world, in the face of the most serious war crimes and crimes against humanity, the legal profession cannot remain silent. We have a shared responsibility to ensure the observance of the principles of the rule of law, equality before the law and restoration of international peace and security," said Tetiana Antsupova. Concluding her speech, she expressed gratitude for the support and mutual understanding shared by European and American colleagues.
