The Venice Commission considers the Ethics Council’s work to be successful and deems it as possible to use its experience while reforming other bodies of the justice system.
This is mentioned in the Venice Commission’s Opinion “On Amendments to Certain Legislative Acts of Ukraine on Improving the Procedure for the Selection of Candidates for the Position of Judge of the Constitutional Court of Ukraine on a Competitive Basis” issued on November 23.
Hence, it is suggested to take into consideration the Ethics Council’s experience while forming the Advisory Group of Experts (AGE), the task of which consists in helping three nominating bodies evaluate moral qualities and legal competencies of candidates for the positions of judges of the Constitutional Court of Ukraine. The Opinion emphasizes that “the Venice Commission has received very positive assessments of its effectiveness”.
Besides, the Opinion emphasizes that the Advisory Group of Experts may rely on “Methodology for assessing compliance of a candidate for the position of the member of the High Council of Justice and members of the High Council of Justice with the criterion of professional ethics and integrity”, which governs the Ethics Council’s work, in order to develop its own methodology for assessment of “moral qualities” and “legal competencies” of candidates for the positions of judges of the Constitutional Court of Ukraine.
